Is it necessary to get a patent on handmade designer jewelry?
I am filing for a trademark ( name ) currently, but I am wondering if it is necessary to get a patent also. Since jewelry styles are usually copied, even though unique styles are produced from time to time. It's just such a big expense to get the trademark and a patent too. I definitely wanted the trademark to protect my name though.
Jewelry is only copyrighted (unless you patent some unique latching mechanism). So you print a catalog of your jewlery, include a copyright notice, and if you catch anybody making the same thing, you can sue them for copyright infringement.
